The bench of Justice Arun Mishra and S Abdul Nazir has given this ruling on the appeal of the Deputy Chief Minister.

The apex court has said that voluntary retirement will be accepted automatically or there is a need to issue order about it, depending on the language used for it, will depend on the language used. The question of consideration in front of the court was the question of whether the employee under the modified Fundamental Rule 56 of Uttar Pradesh gives uninterrupted authority to take voluntary retirement by giving three months notice to the Government or the State Government, according to the extension attached to Rule 56 (C) Can reject his demand on the basis of. The court said that the notice period of voluntary retirement will not be considered as effective automatically after three months have passed. The appointment authority will either accept the notice or reject it. The employee does not have complete right to voluntary retirement.
Under the public interest, freedom of employment
The court said that the right to voluntary retirement is not bigger than the right of life. The government can reject such a demand in view of the public interest. That's because the general public also has the right to be treated with super-skilled specialist, not from the double standards. The top court said that freedom of employment is subject to public interest. After coming into the job, this right can be claimed only according to the rules. The court said that if all such doctors were allowed to retire, disorder will arise and no doctor will remain in the government hospital.
